America – The Green Wave of Legalization
Well it’s happening, cannabis tourism and more states are legalizing marijuana for over 21 years old consumption. Voters in Oregon, Washington DC and Alaska have approved pro-marijuana legislation, adding to the growing number states legalizing over 21 cannabis use. The wins in these states have pro-legalization supporters on a “high” note as the momentum is growing and they are already looking towards 2016.
Oregon
Oregon’s law legalizes personal possession manufacture and sales of cannabis to people 21 years old or older. This law is similar to the laws in Washington in Colorado but the Oregon law has a commercial regulatory system that oversees the production distribution and sale of cannabis.
One thing that makes the Oregon laws different are the limits on how much individual can possess grow or buy. The law states adults over 21 can possess up to 8 ounces of marijuana but can grow to no more than four plants in their household. Now this is the total amount that is limited for the household. Each adult can possess up to 1 ounce in public, adults 21 can also give but not sell up to 1 ounce of marijuana or up to 16 ounces of marijuana products in solid form or up to 72 ounces of marijuana products in liquid form to other adults. Oregon will also have cannabis concentrate manufacturing for edibles and hash.
Oregon’s law mimics Colorado’s law as far as public use, under 21 consumption, growing and retail locations. Oregon’s initiative was pushed through by the pro legalization groups “Drug Policy Action” and the “New Approach” PAC fund which have been building their support base and building up their legalization effort budgets. One of the biggest supporters is the billionaire George Sorros, who donated more than $200 million dollars to the “Drug Policy Alliance” which is a New York based group of the “Drug Policy Action” group in Oregon.
Alaska
In Alaska the law is similar to Oregon, in which state will tax and regulate the growing, sale and use of cannabis, making it accessible to adults over 21 years old. They will also be able to manufacture concentrates, to be used in edibles or as hash. Alaska’s law very closely mimics Colorado’s law as far as public consumption, under 21 possession, where can be grown and sold.
Adults can possess up to one ounce of cannabis and to grow up to six plants, three of which may be flowering, in their households. They will also be allowed to possess all of the cannabis grown from their plants, but it has to remain at the location where the cannabis was grown. Also, 21 and over adults may gift up to an ounce of cannabis and up to six immature plants to other individuals 21 and older. They cannot be compensated for these transactions. Adults 21 and older will also be allowed to purchase up to an ounce of marijuana from properly registered businesses.
One of the biggest supporters in legalization efforts in Alaska is ” Campaign to Regulate Marijuana like Alcohol”. This campaign is a twin of the campaign run in Colorado and has been very successful. Some supporters also think that the Alaska TV reporter Charlo Green also helped to bring attention for the campaign with her now famous “Fuck it I quit” speech on live TV.
Washington, DC
Now in Washington, DC it’s a different story. Washington, DC allows for any person over 21 to possess up to 2 ounces of marijuana for personal use and they are allowed to grow up to six plants in their home. This law also allows adults to transfer up to 1 ounce of marijuana to another adults but they can not sell it.
Washington DC’s passage of I-71 does not legalize marijuana sales.
The DC Council is considering legalization that would allow the city to regulate and tax businesses that cultivate marijuana for retail sales. There is one caveat to the whole process in Washington, Congress has to approve. Washington DC is a district is not considered a state so Congress has last word on laws.
*Note- None of these new laws will be enacted till January 2015 or later. So don’t run outside and light up!!
